Polymedica Corporation and two of its wholly-owned subsidiaries have agreed to pay $35 Million Dollars to settle two qui tam actions filed by two private relators, Donna Ben-Barrack and Claire Schultz. The allegations of the case were that the companies submitted claims to Medicare without proper documentation and that they violated the False Claims Act by not obtaining a signed doctor’s order or prescription for medical products for which the companies had submitted reimbursement claims to Medicare.
Ms. Ben-Barrack and Ms. Schultz, will receive a share of the $35 Million Dollar settlement, for having filed the qui tam cases.
